These General Terms of Purchase regulate the use of the website www.ordeponent.com (from here on, the website), of which GRUP COOPERATIU FRUITS DE PONENT SCCL is the owner.
The domain www.ordeponent.com and all associated subdomains belong to GRUP COOPERATIU FRUITS DE PONENT SCCL, NIF: F-25284209, located at Carretera de Vallmanya, Km 1, Alcarràs, Lleida.

Purpose
The Terms of Purchase establish the rights and obligations of all users of the online store of MOLÍ D’ALCANÓ in relation to the products and services we offer through our website.
By using this website or placing an order through it, you are aware that you are bound by these Terms and by our Privacy Policy, and therefore, if you do not agree with all Terms and with the Declaration of Privacy, you should not place any orders.
The purpose of the website is to sell the company’s own products and the products of other cooperatives or producers. Their features are listed on the corresponding pages of this website, as are the particularities of any operations you may perform through it, always in the Catalan and Spanish languages.
These terms may be modified, which is why you must read them before placing every order.
Orders
By placing an order on the web site, you, the purchaser, indicate your full and total acceptance of the prices, descriptions of the products for sale and general terms of sale, which will be the only terms applicable to the contract thus concluded.
The purchaser commits to using the website for the sole purpose of making legally valid inquiries or orders. You are also required to provide us, in a true and accurate way, with your contact information, thereby consenting to our ability to use this information to contact you if necessary.
By placing an order through www.agrobotigaalcarras.com, you attest that you are fully authorised to use your credit card, in the event you choose this payment method. Only individuals with the necessary legal capacity for signing contracts related to the class of goods and services proposed on this website may place orders through www.ordeponent.com.
Orders will be delivered by MOLÍ D’ALCANÓ through its own means or through a transport agency designated by COOPERATIVA itself. Orders will be delivered to the address provided by the customer. AGROBOTIGA D’ALCANÓ takes no responsibility if the delivery cannot be completed due to the provision of inaccurate or incomplete data or if the delivery cannot be completed due to the recipient’s absence. Notwithstanding, AGROBOTIGA D’ALCARRÀS will take all necessary measures to complete the delivery as soon as possible, to the satisfaction of both sender and recipient.
MOLÍ D’ALCANÓ commits to delivering the products in perfect condition to the delivery address provided on the order form. You may request the articles to be delivered to a different address and to a different physical person from the one who makes the order.
Orders will not be delivered to post boxes.
With regard to deliveries in hospitals, public institutions and other properties at which access to the general public is restricted, MOLÍ D’ALCANÓ cannot guarantee that the delivery will be made directly to the recipient and will be considered to have completed the order, and be free of responsibility, once the order has been made available to the recipient in the reception or access control area.
The delivery period of the articles ranges from 2 to 10 business days, depending on whether the order is placed on business days, before holidays or on holidays.
The order delivery period will also depend on the payment method selected. Each delivery method has its own restrictions and/or charges which will be applied to your order. Business days include Monday through Friday, except for local or national holidays.
Payment
MOLÍ D’ALCANÓ offers the possibility of paying online by credit card through a SECURE payment gateway. The customer will RECEIVE the PAYMENT CONFIRMATION the moment it is carried out.
All customer data is completely confidential and protected.
Security in online purchases is guaranteed. They are protected by the security measures required for identifying possible errors in the data provided when paying by credit card.
Your card information will not be saved in any of our databases.
Credit cards are subject to checks and authorisations by their issuing entity, but if said entity does not authorise the payment, we will not be responsible for any delay or failure to deliver and we will not be able to formalise a contract with you.
MOLÍ D’ALCANÓ reserves the right to change the payment methods, being able to create new methods or eliminate the existing ones, without the user/customer being able to file claims for this reason. However, if the change in payment method affects an order which has already been placed, Molí d’Alcanó will get in contact with you to inform you of this change, offering you the option to cancel your order if desired.
Price, period of offer validity and transport cost
When placing your order, you will be informed of the total cost of transport, based on the volume, weight and distance. The prices indicated below each product are total (sales tax included). The prices are listed in euros. The terms and prices listed are those valid at the time and apply only to the open session. The order confirmation information shown, before the purchaser accepts the operation, clearly specifies the price of each selected article, the exact delivery expenses to be applied to the operation and any offers or discounts which may be applicable.
When an order is placed through the website, the corresponding receipt is sent to the customer on paper along with the delivery. You may request any information about your order by email at molialcano@fruitsponent.com.
AGROBOTIGA D’ALCARRÀS reserves the right to modify the sales prices listed ON THE MOLÍ D’ALCANÓ WEBSITE at any time, but the articles will be billed according to the rates displayed when the order is registered under reservation of availability on this date.

Returns
Right to cancel: Art. 44 of Law 7/1996, of 15 January, on the Regulation of Retail Trade, grants the Customer the right to cancel the order requested within a period of 14 calendar days from its receipt, after informing MOLÍ D’ALCANÓ (via email at molialcano@fruitsponent.com), with the refund of the amount paid for the product. The product refund will be exercised without penalties in such a way that MOLÍ D’ALCANÓ will proceed to the reincorporation of the total purchase amount, excluding any shipping costs which may have been incurred. MOLÍ D’ALCANÓ offers the possibility to return any product acquired by delivery or in-person at the physical stores of MOLÍ D’ALCANÓ, IN ALCANÓ. To be able to effectuate the return, the product must be complete and in perfect condition. With respect to the packaging of the returned product, it does not need to be its original condition, but if this were to be the case, the product may suffer a loss in value.
Return due to product defects, defects produced in transport or shipping error: if at the time of delivery it can be clearly and visibly noticed, without the need to handle the shipping materials or packaging pertaining to the product, that a product has defects caused by damage during transport or if, also during the period of guarantee, a defect in the merchandise received is noticed, the customer may inform MOLÍ D’ALCANÓ (via email at agrobotiga@fruitsonent.com) within a 7-day period from the date the product is received. MOLÍ D’ALCANÓ will be responsible for replacing it for a new item or reimbursing the amount paid. The repair and/or replacement of the defective product will be free for the consumer and user. This free repair and/or replacement will cover the necessary expenses made to redress the products’ lack of conformity with the contract, especially shipping costs, as well as the costs associated with labour and materials.
If a product proves to be defective, the sales agent must proceed, accordingly, to the repair, replacement, discount or resolution of the contract, procedures which will be free for the consumer and user.
Responsibility
MOLÍ D’ALCANÓ will not be considered responsible for any damages, regardless of their nature, whether material or immaterial or corporal, which may result from the inadequate operation or use of the products sold.
The same applies to any possible modifications made to the products by the suppliers. MOLÍ D’ALCANÓ will not be considered responsible to a customer or third party for any indirect harm, loss of use or profit caused by any means even if this harm, loss or damage could have been foreseen by MOLÍ D’ALCANÓ or if it could have taken place in the company’s knowledge.
MOLÍ D’ALCANÓ will not be considered responsible for any noncompliance with the signed contract caused by force majeure, by an interruption in activity or a total or partial strike (especially of postal, transportation or communication services), by flood or by fire.
The provisions of the present clause will affect neither the legally recognised consumer quality rights nor the right to cancel the contract.
In the event of a legal dispute, the customer may address, firstly, MOLÍ D’ALCANÓ to reach a friendly accord.
Intellectual property rights and other rights
The purchaser recognises and accepts that the intellectual property, industrial or other elements and rights (including but not limited to copyrights, patents, brands, designs, photographs, images and font types) related to the web platforms of COOPERATIVA D’ALCARRÀS which the purchaser may access are the exclusive property of COOPERATIVA D’ALCARRÀS. The user may not, directly or indirectly, copy, modify, alter, publish, communicate, distribute, sell or transmit the materials of this platform or its font type, or of any downloads performed, in whole or in part, without written permission from MOLÍ D’ALCANÓ.
Applicable law
The present General Terms will be governed and interpreted according to current law. For any judicial dispute arising from the commercial relationship between the user and MOLÍ D’ALCANÓ, both parties agree to submit themselves to the provisions of the relevant current law.

Our company and user agree to submit to the Judges and Courts of the user’s domicile, provided that the user is located in Spanish territory and acts as a consumer.
Claim resolution system
These General Terms are governed by Spanish law. The parties freely submit themselves, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user’s place of residence.
